TRIBAL EMPLOYMENT RIGHTS OFFICE (TERO)

By virtue of a contractual agreement with EEOC, TERO is authorized to:

  • Interview and counsel individuals with potential employment discrimination charges.

  • Draft Charges of alleged violations of Title VII, file with EEOC and attempt to resolve the charge by mediation within 30 days; Negotiate written Indian Preference agreements with employers operating on and near the Wichita and Affiliated Tribes.

  • Continue development of public awareness of the complaints resolution process under Tribal Ordinance and of Title VII protection against employment discrimination.

  • Continue referral services to provide a point of contact between employers operating on or near the Wichita and Affiliated Tribes and residents of the Wichita and Affiliated Tribes with skills required by those employers.

  • Continue on-site inspections of employers doing business with the Wichita and Affiliated Tribes to assure that goals and timetables agreed to are being met.

TERO IS RESPONSIBLE FOR ENFORCING THE TRIBAL EMPLOYMENT RIGHTS ORDINANCE OF THE WICHITA AND AFFILIATED TRIBES:


Which requires all employers doing business with the Wichita and Affiliated Tribes to give preference to Indians in hiring, promotions, training and all other aspects of employment, contracting and subcontracting.

TERO IS AWARE OF THE RELATIONSHIP BETWEEN TITLE VII AND INDIAN PREFERENCE, SECTION 703 (i) OF TITLE VII OF THE CIVIL RIGHTS ACT OF 1964, AS AMENDED:

Which permits employers on or near Indian reservations to give publicly announced employment preference to Indians living on or near reservations.

TERO monitors tribal contracts:

Public Law 93-638, Indian Self-Determination and Education Assistance Act, Section 7 (b):

Which requires any contract, subcontract, grant or sub-grant authorizing Federal contracts with or grants to Indian organizations or for the benefit of Indians, shall to the greatest extent feasible. Provides:

  • Preferences in opportunities for training and employment for Indians.

  • Preference in the award of subcontracts and sub-grants to Indian organizations and to Indian-owned economic enterprises.


EXECUTIVE ORDER 11246:

Which prohibits discrimination in Federal employment and in employment by Federal contractors because of race, color, religion, sex or national origin.
